Terms and Conditions of Sale – Removals and Delivery

1. Scope

These general terms and conditions apply to all removal and transport services provided by Ecotri Solutions Sàrl (hereinafter «Ecotri»). By confirming a booking, the customer confirms that they have read and accepted these terms and conditions.

2. Offer and confirmation

Quotations are drawn up on the basis of the information provided by the client and, where applicable, a site visit. They are valid for [30] days. The contract is confirmed by written acceptance of the quotation (by email or signature). Any significant discrepancy between the description provided and the actual situation (volume, access, number of storeys, additional items) may result in a price adjustment.

3. Rates and time recording

Services are invoiced in accordance with the quotation, at the hourly rate (including VAT) or at the agreed flat rate. Time is calculated from the moment we leave our Borex depot until our return / upon arrival on site, in 15-minute / 30-minute increments, with a minimum of one hour(s). Packing materials (cardboard boxes, bubble wrap, extra blankets) are charged according to usage, unless otherwise stated in the quotation.

4. Included and optional services

Unless otherwise stated in the quotation, the service includes the loading, transport and unloading of goods at the locations specified by the customer. Packing, dismantling and reassembling furniture, fitting light fittings or appliances, cleaning the premises and disposing of items are optional services, which will be charged separately. Ecotri does not carry out any electrical, plumbing or connection work requiring a licence.

5. Packaging and fragile items

Where the customer packs their own belongings, they are responsible for ensuring the boxes are properly packed. Ecotri accepts no liability for damage to the contents of boxes that it has not packed, unless there is proven negligence during handling. Boxes must be sealed, clearly labelled and of a reasonable weight.

6. Items excluded from carriage

The customer shall keep valuables (jewellery, cash, securities, important documents, computer data, high-value works of art) in their own safekeeping, unless otherwise agreed in writing in advance. Ecotri does not transport animals, dangerous or flammable goods (gas, fuel, chemicals, ammunition) or perishable goods.

7. The customer’s obligations

The customer shall ensure access to the loading and unloading areas on the agreed day. They shall be responsible for booking the lift if necessary and for obtaining any permits required for parking or use of public land. They shall give advance notice of any particularly heavy, bulky or fragile items (pianos, safes, aquariums, etc.), as well as any access difficulties. The costs of permits and parking are to be borne by the customer. Waiting time resulting from blocked access or items not being ready will be charged at the hourly rate.

8. Cancellation and postponement

Any cancellation or rescheduling is free of charge up to 7 days before the move. Between 7 days and 48 hours in advance, 30 % of the quote amount will be charged. Less than 48 hours in advance, 50 % will be charged. If the customer fails to attend the appointment, the time spent on the job will be charged.

9. Payment

A deposit of [30 %] is required upon confirmation of the booking. The balance is payable in cash or via TWINT at the end of the service, or by invoice payable within 30 days. Payment by invoice incurs an additional charge of CHF 20 for administrative costs. In the event of late payment, reminder fees of CHF 50 per reminder may be charged, as well as default interest at a rate of 5 % per annum (Art. 104 of the Swiss Code of Obligations).

10. Liability and insurance

Ecotri is covered by third-party liability insurance [and for goods in transit up to CHF 20,000 per move]. It is liable for damage caused by the negligence of its employees during handling or transport. It is not liable for normal wear and tear, pre-existing defects, items poorly packed by the customer, or damage due to force majeure. For goods of a higher value, the customer may request additional insurance, which will be charged separately.

11. Damage assessment

The customer must check the condition of their goods upon delivery. Any visible damage must be reported immediately and noted on the completion certificate. Any hidden damage must be reported in writing within 8 days of delivery (Art. 452 of the Swiss Code of Obligations). After this period, no claims will be accepted.

12. Delays

Ecotri endeavours to adhere to the agreed timetables. It cannot be held liable for delays caused by circumstances beyond its control: traffic conditions, weather, blocked access, unforeseen breakdowns or force majeure.

13. Data protection

The client’s personal data is processed in accordance with the Federal Data Protection Act (FADP). It is used solely for the purposes of fulfilling the contract and invoicing, and is not disclosed to third parties, except for those partners necessary for the fulfilment of the contract.

14. Governing law and jurisdiction

Swiss law shall apply. The place of jurisdiction shall be Nyon, subject to any mandatory rules of jurisdiction provided for by law, in particular those in favour of consumers.

Terms and Conditions of Sale – Clearance Sales

1. Scope

These general terms and conditions apply to all clearance services provided by Ecotri Solutions Sàrl (hereinafter «Ecotri»). By confirming a booking, the customer confirms that they have read and accepted these terms and conditions.

2. Offer and confirmation

Ecotri’s quotations are drawn up on the basis of the information, photographs and videos provided by the customer. They are valid for [30] days. Any significant discrepancy between the description provided and the actual situation (volume, access, nature of the items) may result in a price adjustment.

3. Prices

The rate is CHF 270.- per hour (including VAT). This includes two qualified staff members and a 4.2-tonne lorry fitted with a tail lift. Time is charged [from the moment we leave our depot in Gland until our return / from the moment we arrive on site], in 30-minute increments, with a minimum charge of 1 hour.

4. Disposal costs

For small clearances, a flat-rate fee of CHF 100 is charged for waste disposal. For medium and large clearances, items are taken to a private waste disposal centre and the amount charged by that centre is passed on to the customer upon presentation of a receipt.

5. Excluded items

Unless otherwise agreed in writing in advance, Ecotri does not accept special waste: chemicals, paints, solvents, oils, asbestos, gas cylinders, ammunition and any other hazardous items. The customer is required to report the presence of such items. Ecotri reserves the right to refuse to accept them.

5.1 Volume greater than that stated

If Ecotri finds, upon arrival at the site, that the volume or nature of the items to be cleared significantly exceeds what was stated or estimated on the basis of the information provided by the customer (description, photos, videos), Ecotri reserves the right to charge an additional fee. This additional charge may relate, in particular, to disposal costs, for example, switching from a flat-rate waste disposal fee to invoicing based on the private waste disposal centre’s receipt. The customer will be informed of this before work continues, and it will only apply with their consent. In the absence of such agreement, Ecotri will only carry out the service initially agreed, and the time already spent on the job remains payable.

6. The customer’s obligations

The customer warrants that they are the owner of the items to be removed or that they are authorised to dispose of them. They shall ensure that the premises are accessible on the agreed day and that a parking space is available nearby. Any parking or permit fees are to be paid by the customer. Waiting time resulting from the premises being inaccessible will be charged at the hourly rate.

7. Valuables and documents

The customer is solely responsible for removing, in advance, any valuables, personal documents, money or mementoes that they wish to keep. Items handed over to Ecotri are deemed to have been abandoned for the purposes of disposal, recycling or recovery. Ecotri accepts no liability for items left on the premises in error.

8. Cancellation and postponement

Any cancellation or rescheduling is free of charge up to 48 hours before the appointment. After this time, a fee of CHF 270 will be charged. If the client fails to attend the appointment, one hour’s service will be charged.

The client’s personal data is processed in accordance with the Federal Data Protection Act (FADP). It is used solely for the purposes of fulfilling the contract and invoicing, and is not disclosed to third parties, except for those partners necessary for the fulfilment of the contract.

12. Governing law and jurisdiction
